NOTICE OF PUBLIC HEARINGS

Notice of forthcoming public hearings, other than those notified in the notice issued on 28th March, 2003, will be posted on the Commission's website on the Thursday evening preceding the week in which the hearing will take place. Details of the time, date and venue for such public hearings will also be available in hard copy on request directly from the offices of the Vaccine Trials Division of the Commission to Inquire into Child Abuse.

The Vaccine Trials Inquiry was a Division of the Investigation Committee.

Judicial Review proceedings seeking, inter alia , a declaration that the Order which established the Vaccine Trials Inquiry was ultra vires the Act of 2000, were initiated in November 2003. On 25 November, 2003, an undertaking was given to the High Court, by the Commission, that it would not conduct any hearings in relation to the matters within the ambit of the Order, until the matter was settled. The practical effect of this undertaking was that the work of the Division was suspended at that point and never re-commenced, given the subsequent decision of the Court, that the Order was ultra vires the Act.

Purpose: To address outstanding procedural and other issues concerning the

public hearings in relation to Trial 1 scheduled to commence on the

17th June 2003.

NOTICE

Proposed Timeframe for Public Hearings in relation to Trial 1 announced by Counsel for the Commission at Procedural Hearing held in Public on 20th March 2003.

8th April 2003:

Public Procedural Hearing to deal with outstanding issues in relation to legal representation and any other issues which may arise.

11th April 2003:

Deadline for receipt of statements or other documentation from parties involved, or who believe they should be involved, in Trial 1.

25th April 2003:

Books of Documents to be issued to parties who are, or who may possibly be, involved in Trial 1.

6th May 2003:

Public Procedural Hearing to address issues arising in relation to the Books of Documents and any other issues.

17th June 2003:

Commencement of Public Hearings in relation to Trial 1.

Vaccine Trials Inquiry
Public Hearings scheduled to commence on the 1st July 2003.

By reason of the fact that the attendance of a witness whom the Division considers to be central to it inquiry into Trial One, is the subject of pending litigation, it is considered that it would be inappropriate to commence public hearings until such time as that issue has been resolved. The Division had hoped that this would have occurred prior to the 1st of July 2003, but unfortunately this has not proved to be the case.

In the circumstances, the Division will sit at 10.30am on the 1st July 2003 for the purpose of fixing a new date for the public hearing and will hear any submissions which any party represented wishes to make in relation thereto.


Vaccine Trials Inquiry
Public Hearings in relation to Trial 1.

At the public hearing of the Vaccine Trials Division held on 1st July, 2003 the public hearings in relation to Trial 1 were adjourned without fixing a new date pending the conclusion of an appeal to the Supreme Court which was due to be heard on 29th July following.

The Supreme Court delivered judgment on the appeal on 31st July, 2003. The implications of the judgment are now being considered.

It is hoped that by early September 2003 the Division will be in a position to post a further notice concerning the public hearings in relation to Trial 1.
